The journey started back in 2008, when voters approved the Michigan Compassionate Care Initiative. Intended to legalize the medical use of cannabis, the legislation was subject to a legal battle that eventually led the Supreme Court of Michigan to rule in 2013 that the initiative did not, in fact, allow for the operation of medical cannabis dispensaries.

In the injunction awarded in December, District Court Judge Robert Pitman wrote that “social media platforms have a First Amendment right to moderate content disseminated on their platforms.”
In granting the injunction, Pitman wrote that the plaintiffs had shown the “likelihood of success on the merits” of the case, noting several constitutional flaws in the statute, including its vagueness, overbreadth and discrimination “based on content and speaker.”

“Similarly, when we as creators allow these same companies to sponsor our podcasts or youtube videos, we open the door for them to reach more active and engaged creators,” concluded Michaels. “It’s the perfect opportunity for everyone.”
